8. Proposing violence at public gatherings (Section 26 Public Order Ordinance)

Any person who, without lawful authority, at any public gathering makes any statement, or behaves in a manner, which is intended or which he knows or ought to know is likely to incite or induce any person —

  1. to kill or do physical injury to any person or to any class or community of persons;
  2. to destroy or do any damage to any property; or
  3. to deprive any person by force or fear of the possession or use of any property either permanently or temporarily,

shall be guilty of an offence and shall be liable —

  • on conviction on indictment, to imprisonment for 5 years; and
  • on summary conviction to a fine of $5,000 and to imprisonment for 2 years.
