B. Capacity to Consent

In Hong Kong, an adult patient (one who has attained the age of 18 and is not “mentally incapacitated”) is able to give a consent that is valid under the law.

A person who is “mentally incapacitated” may still be able to give consent if he or she can understand the general nature and effect of the treatment.
