I. Smoking Products and Smoking
Regulation of smoking products and smoking in Hong Kong is mainly provided for under the Smoking (Public Health) Ordinance (Cap. 371), the Fixed Penalty (Smoking Offences) Ordinance (Cap. 600), and the Import and Export Ordinance (Cap. 60) and their relevant subsidiary legislation.
The Smoking (Public Health) Ordinance, enacted in 1982, covers a wide range of areas, including the designation of no-smoking areas, the sale of conventional smoking products, requirements on packaging and labelling, restrictions on advertising and promotion, regulation of alternative smoking products, protection of minors, as well as enforcement procedures and penalties.
The Fixed Penalty (Smoking Offences) Ordinance, which came into operation on 1 September 2009, establishes a fixed penalty system for certain smoking offences under the Smoking (Public Health) Ordinance (such as smoking in no-smoking areas) and sets out the procedures for recovering the penalties.
The Import and Export Ordinance establishes criminal liability in respect of the import of alternative smoking products.
