1. I was injured at work. Is the legal procedure for my claim against my employer for employees' compensation different from the procedure for a personal injury claim in respect of the same injury?
For work-related injuries, the legal procedure for employees' compensation is governed by the Employees' Compensation Ordinance (Cap. 282) which is not the same as in personal injury cases, as described above.
Where any injury is caused to an employee by the negligence, breach of statutory duty or other wrongful act or omission of the employer and any other person or entity, the injured employee may also bring separate common law claims for damages independently from an employee's compensation claim under the ECO.
