Criminal responsibility

Every person is, unless the contrary is proved, presumed by law to be sane, unless you are under the age of criminal responsibility (10 years old).

 

The fact that a person suffers from mental disability does not automatically mean they do not need to bear criminal responsibility.

 

Whether a person suffering from mental disability needs to bear criminal responsibility depends on:

 

  • Whether they are fit to be tried
  • If yes, whether they can raise a defence of insanity
  • If no, whether they did the act or made the omission, and whether they are found to be under a disability
