Payment for necessary goods and services
MIPs, notwithstanding their mental incapacity, still need to pay for a reasonable price for necessary goods and services sold and delivered to them. “Necessaries” are judged relative to the person’s station in life and actual requirements at the time of supply (e.g. food, clothing, accommodation, medical treatment appropriate to their condition). The obligation is to pay a “reasonable price”, not necessarily the contract price if that is excessive: Sale of Goods Ordinance (Cap. 26), section 4.
