Partnership

An MIP who is incapable of managing his/her own property and affairs will be, by definition, unable to enter into a partnership.

If an MIP falls into incapacity after entering into a partnership, the committee appointed under Part II of the Mental Health Ordinance (Cap. 136) can deal with the partnership for him. Dissolving a partnership falls under the scope of powers of the committee: Mental Health Ordinance (Cap. 136), section 11(2)
