Transfer of guardianship

If the guardian dies, or gives written notice to the Guardianship Board indicating his desire to relinquish the functions of guardian, the general rule is that the guardianship will be vested in the Director of Social Welfare. This is subject to a review by the Guardianship Board.

On the other hand, if the guardian becomes incapacitated (such as from illness) from performing the functions of a guardian, then the functions shall be exercised by the Director of Social Welfare, or other persons approved by the Guardianship Board, during the guardian’s incapacity. This, again, is subject to the Guardianship Board’s review.
