Nature of guardianship

Guardianship is a protective measure for mentally disabled persons over the age of 18, aiming to deal with matters about their daily lives. Examples include: where should they live, who can visit them, who should take care of them. The Guardianship Board performs a vital function in the care and supervision of mentally incapacitated persons (MIPs) by granting such guardianship orders and reviewing them. 

 

Guardianship orders are only available for mentally incapacitated adults. For mentally incapacitated minors (under the age of 18), it is more appropriate to apply for care and protective orders under the High Court wardship jurisdiction.
