Review and appeal

A guardianship order can be reviewed either on the Guardianship Board’s own initiative, or upon request by any persons entitled to request a review. 

 

The MIP, the guardian, any other persons with a genuine interest in the MIP’s welfare (such as a relative) can request the Guardianship Board to review the guardianship order: Mental Health Ordinance, section 59U(4)

 

Upon review, the Guardianship Board may:

  1. Vary the guardianship order, such as appoint another guardian; 
  2. Suspend or revoke the guardianship order; or 
  3. Take no further action.
