E. What if the goods pawned were stolen?

Where it appears that the goods have been unlawfully pawned with a pawnbroker, the Court may make an order in accordance with section 23 of the Pawnbrokers Ordinance (Cap. 166) to dispose of the goods in a manner the Court considers just.

 

In coming to a decision on how to dispose of the goods, which may include ordering the delivery of the goods to the owner on payment, or without payment to the pawnbroker, the Court would take into account the conduct of the owner and the pawnbroker to consider if the fault or carelessness of either party has contributed to the unlawful pawning of the goods.
