B. Authority of the owner of the goods

No person may pawn goods owned by another unless he is duly authorised or employed by the owner of the goods in that behalf.

 

Any person who contravenes this requirement commits an offence and is liable to a maximum fine of HK$25,000 and imprisonment for 1 year.

 

If the Court is satisfied that it is probable that certain goods have been pawned without the authority of the owner, it may issue a warrant for searching any place where the goods may appear to him to be. If the goods are found upon such search, the Police who executes the warrant shall seize the goods and take them into safekeeping.
