1. Does Hong Kong law apply to the tenancy of overseas properties?

Subject to any laws in the jurisdiction where the property is located, the governing law is determined primarily by the express terms of the tenancy agreement.

 

In the absence of an express or implied agreement between the parties, the Hong Kong courts would generally regard the contract as governed by the law with which the contract has its closest and most real connection.  Given that the subject property is located outside Hong Kong, this is a strong pointer that the tenancy is governed by the laws of the place where the property is situated.
