1. Can the tenant withhold some portion of the rent if the landlord fails to fulfill his obligation to repair?

The short answer is ‘No’.  It is well established in case law that, unless there is express agreement to the contrary, the tenant’s covenant to pay rent is independent of other covenants or obligations under the lease, including the compliance by the landlord of its obligation to repair.
