2. A business owner with whom I am involved in disputes disclosed my personal data on social media platforms along with some negative comments, is he liable for an offence?

Yes, he/she may be liable for an offence. In an analogous Hong Kong court case where a defendant had a monetary dispute with the victim regarding her online trading business, and thus disclosed the personal data of the victim and her husband on a social media platform alongside allegations about the victim’s fraudulent behaviour, the defendant was ultimately convicted of the first-tier offence under section 64(3A) of the Ordinance, and was sentenced to two months’ imprisonment, suspended for two years.
