1. My friend shared a copy of my HKID and other personal data with others on a messaging platform, did he commit an offence?
If you have not voluntarily given your friend any express consent for him to disclose your personal data, then he has likely committed an offence under section 64(3A) of the Ordinance, provided that:-
- He had the intent or was being reckless as to whether any specified harm (e.g. harassment, molestation, pestering, threat, intimidation, or psychological harm) would be, or would likely be, caused to you or any of your family members; and
- No applicable defence applies to him.
If, on top of the above, your friend’s disclosure of your personal data has indeed caused specified harm to you or any of your family members, he has likely committed an offence under section 64(3C) of the Ordinance.
