A. Commercial surrogacy

Hong Kong does not recognise commercial surrogacy agreements. In fact, it is a criminal offence to enter into such an agreement: no person shall make or receive any payment, whether in Hong Kong or elsewhere, for arranging, offering or taking part in a surrogacy arrangement, and this criminal offence is punishable with a level 4 fine and six months' imprisonment on first conviction (sections 17 and 39 of the Human Reproductive Technology Ordinance (Cap. 561)). It is a summary offence, with a time limit of six months "from the time when the matter of such complaint or information respectively arose" for prosecution.
