19. What offences does the owner of a party room commit when they provide a karaoke machine that contains infringing copies of songs for customers to sing?
The owner may have committed the following offences under the Copyright Ordinance:
- Section 118(2A) which prohibits any person to possess infringing copies of a copyright work for the purpose of or in the course of any trade or business with a view to it being used by any person without the licence of the copyright owner.
- Section 118(8B) which prohibits any person from communicating the work to the public for the purpose of or in the course of any trade or business that consists of communicating works to the public for profit or reward or to such an extent as to affect prejudicially the copyright owner.
If convicted, the offender is liable to a fine of $50,000 and imprisonment for 4 years.
