Q2. What potential compensation would I be entitled to if liability is established?

If liability is established, without intending to be exhaustive, the potential compensation may include, but is not limited to, the following broad categories, provided they are caused by the relevant accident, breach or negligence:

  1. For personal injury suffered in or as a result of the fire, a civil claim may include, amongst other things, medical expenses, rehabilitation costs, loss of earnings, future loss of earning ability, pain, suffering, and loss of amenities, and, in appropriate cases, recognized psychiatric injury if it is established by sufficient medical evidence. 
  2. If a person died in or as a result of the fire, the law provides additional claims for family members. An action may be brought under the Fatal Accidents Ordinance (Cap. 22) for the benefit of the dependents of a deceased person against the person who would have been liable to the deceased. The claim may include, amongst other things, bereavement damages, loss of financial dependency, loss of services, and funeral expenses.
  3. For tenants, his claim in a civil action may include, amongst other things, the value of his personal belongings damaged or destroyed in or as a result of the fire, and loss for being unable to live in the relevant premises or temporary accommodation, if these were caused by the fire and were reasonably incurred.
  4. For flat owners, the relevant property loss may include, amongst other things, the reasonable cost of repair or reinstatement, cleaning, removal of debris, replacement of damaged household items, loss of rental income, and loss for being unable to live in the relevant premises or temporary accommodation, if these were caused by the fire and were reasonably incurred.
