c) Apportionment

The issue of apportionment of rent may arise when:

(a) there is a break in time during the term of the tenancy; or

(b) there is a change of ownership of the subject property.

 

Under section 3 of the Apportionment Ordinance (Cap. 18), with the exception of rent payable in advance, rent accrues from day to day and shall be apportionable in time accordingly.

 

Where there is a change of ownership of the property during the currency of the tenancy, the rent payable is normally apportioned between the former landlord and the new landlord respectively.  In practice, the former landlord normally would receive the rent for the whole month and apportion the rent to the new landlord upon the completion of the conveyance.
