6. As a judgment creditor, can I enforce the judgment if the judgment debtor has lodged an application for permission to appeal?
The fact that the judgment debtor has lodged an application for leave (permission) to appeal does not mean that enforcement of an award or order must be withheld. However, an order withholding enforcement of judgment may be made by the Tribunal, the Court of First Instance or the Court of Appeal on such terms as the court thinks fit. If you realise that the debtor is appealing, you must check whether there is any court order granted to withhold your enforcement before taking further action.
