10. How long does maintenance pending suit last?

 

Maintenance pending suit (“MPS”) is temporary. 

 

It usually continues until the final determination of the matrimonial proceedings or until further order of the court. It will cease upon the decree is made absolute or when the suit is determined. 

 

By contrast, litigation funding awarded as part of MPS is commonly ordered to last only until the Financial Dispute Resolution hearing. If the FDR is unsuccessful, the court is at liberty to extend the litigation funding order to cover the costs up until the final trial upon further application be made by the applicant.
