4. Interim maintenance for children

 

Interim maintenance for children is a form of statutory relief governed by section 5 of the Matrimonial Proceedings and Property Ordinance (Cap. 192), allowing the court to order payments for the benefit of a child of the family before a final decree is pronounced.  

 

The primary objective of interim maintenance is to sustain any children during the pendency of divorce litigation. 

 

These orders are based on the principle of reasonableness, typically determined via a “broad-brush” approach that avoids detailed financial investigations in favor of meeting the child’s immediate and reasonable requirements.
