4. Can statutory annual leave or maternity leave be included in the notice required to terminate a contract of employment?
Where an employer or an employee wants to give a notice to terminate the contract of employment, the period of notice cannot include statutory annual leave or maternity leave. For example, if an employee is contractually required to give a one month’s notice, he or she cannot give a shorter one just because he or she has, say, half a month of unused annual leave.
